Copyright Policy, Restrictions on use of Materials

• All photographs captured by the FlyDining PhotoPass service, which include photographs captured during the FlyDining Session, are owned and copyright protected by FlyDining. Please be aware that it is illegal to reproduce or distribute copyrighted material without the permission of the copyright owner. Purchased prints and other products may not be reproduced without permission from FlyDining. Accessing pictures or text provided on websites does not give you any rights to use them. Only the copyright owner, or the owner’s legal agent, can grant permission to copy, distribute, or publicly display protected material.
• Purchasers of FlyDining PhotoPass photo downloads receive, and such photos are subject to, a limited license for personal, non-commercial use of the downloaded photos and other digital content, as available.
• Unless it is expressly prohibited, guests are permitted to take photographs and recordings within certain areas of the FlyDining.
• Guests agree not to intentionally photograph and/or capture video footage of any individual without that person’s permission and guests must adhere to all photography/filming restrictions.

Storage Policy and Photo Availability

• FlyDining PhotoPass photos linked to a FlyDining account are usually available online within 48 hours after the photos were taken. Guests must claim photos before they expire. All PhotoPass photos and other digital content (including as applicable, such content captured during a FlyDining Session), as available, will expire pursuant to the Expiration Policy of 45 days. We do not offer options for the permanent storing of photos or other digital content. Expired photos and other digital content will no longer be available.
• FlyDining reserves the right to remove or refuse to post or upload any photos at our sole discretion, including photos that contain content of poor quality or that might be deemed to be inappropriate or offensive.
• We are not responsible for missing, lost, or damaged photos or other digital content.
• Certain FlyDining PhotoPass photos may be provided, at your election, to select, FlyDining-approved third-party companies in connection with products and services offered by those third-party companies (collectively, “Third-Party Products”). Not all FlyDining PhotoPass photos are available for use in Third-Party Products, and FlyDining reserves the right to refuse to provide any photos to any third-party companies at our sole discretion. Once certain FlyDining PhotoPass photos are provided to a third-party company, those photos will be subject to the availability, storage, expiration, privacy, and other policies and terms governing that third-party company’s products, services, and site or platform. Neither FlyDining nor any of its affiliates shall be responsible or liable for such third-party company’s products, services, site/platform, or actions.

Merchandise Availability and Delivery

• With respect to Merchandise offered directly by FlyDining (collectively, “FlyDining PhotoPass Products”), receipt of your order does not guarantee that we can supply the selected products to you. All FlyDining PhotoPass Merchandise is subject to availability and we must therefore reserve the right: to limit quantities of products we supply; to supply only part of an order or to divide up orders; and to alter the availability and duration of, and to terminate at any time, any special offers.
• We will use all reasonable means to ensure your purchases of FlyDining PhotoPass Merchandise are delivered promptly but we cannot guarantee that there will be no delays in delivery, and accept no liability or responsibility for delayed delivery of products.
• Availability and delivery of Third-Party Products will be subject to the policies governing that third-party companies’ products and services.
• FlyDining PhotoPass, whether free or paid does not ensure any quantity of photos or media files.

Prices and Payment

• Please note that the prices of FlyDining PhotoPass Merchandise offered on the FlyDining Location and Flydining website does not include sales tax if any, and shipping costs, which vary depending on delivery option and location. Prices are subject to change at any time prior to acceptance of your order and in case of a change, we shall notify you and ask whether you still wish to proceed.
• International Customs Policy: Prices for FlyDining PhotoPass Merchandise do not include duties or value-added taxes. If assessed, these charges are the responsibility of the package recipient, who will be billed for them by the local Customs office. Please keep this in mind if you are shipping your order to a recipient outside India.
• Prices and payment for Third-Party Products will be subject to the policies governing that third-party companies’ products and services.

Additional Terms

• FlyDining Photography service and PhotoPass are intended for your personal use only.
• Downloading or unlocking, or offering to download or unlock, FlyDining PhotoPass photos or other digital content for the benefit of other guests, whether or not you solicit or accept any consideration or remuneration for FlyDining PhotoPass photos or other digital content, is a violation of these Terms and Conditions and the limited license granted to you. Violations may result in the removal of all images associated with your account and termination of your FlyDining account. We reserve the right in our sole discretion, including based on usage patterns, to conclude that you are in violation of these Terms and Conditions.
• Online registration is required.
• FlyDining PhotoPass charges are subject to the host location.
• These Terms and Conditions are subject to change without notice.

We reserve the right to remove or refuse to post photos or other digital content of poor quality or photos or other digital content with inappropriate or offensive subject matter at our sole discretion.

We are not responsible for missing, lost, or damaged photos or other digital content. Online registration is required.
